By accessing or purchasing from the Creator Shop, you agree to these Customer Terms of Service (“Terms”).

Who’s the Seller?

• For all purchases through the Creator Shop, Tradespoke is the Merchant of Record.
  
• The Creator is an independent marketing partner and does not sell or fulfill products.

1) Contact & Roles

• Pre-purchase questions (style, fit, inspiration): contact the Creator via the email or social links shown on this shop.
  
• After-purchase support (order status, delivery, returns, damage/defects): contact Tradespoke at support@tradespoke.com or via site chat.
  
• Suppliers: Products are made and shipped by third-party brands and logistics partners.
  

2) Eligibility & Account

• You must be 18 or older to purchase.
  
• Keep your account credentials secure; you’re responsible for all activity under your account.
  

3) Orders, Pricing & Availability

• We may limit or cancel orders/quantities per person, household, or order.
  
• We may verify identity or payment and refuse or cancel any order prior to shipment.
  
• If we cancel after charging your payment method, we’ll promptly issue a refund.
  

Obvious pricing errors: Orders placed at an obviously erroneous price may be canceled before shipment. If charged, you’ll receive a full refund.

4) Product Information

• Colors, finishes, and dimensions may vary (especially with natural materials).
  
• Read product pages carefully for care notes and whether an item is custom/made-to-order or final sale.
  

5) Shipping; Title & Risk of Loss

• Shipping terms are defined in our Shipping Policy.
  
• Title and risk of loss transfer upon delivery to the ship-to address.
  
• For freight deliveries: note visible damage with the carrier at delivery and notify us within the stated time windows.
  

6) Returns, Exchanges & Refunds

• Returns, exchanges, and damage/defect claims are governed by our Return & Refund Policy, incorporated here.
  

7) Taxes & Billing

• Applicable taxes are calculated based on the delivery address and collected by Tradespoke as Merchant of Record.
  
• Payments are processed by our payment provider(s).
  
• We may require additional verification and may refuse/limit payments to prevent fraud.
  

8) Intellectual Property & User-Generated Content

• The Services and all content are owned by or licensed to Tradespoke or our partners.
  
• By submitting reviews or tagging us/the Creator on social media, you grant Tradespoke a perpetual, worldwide, royalty-free license to use that content (including your name/handle) for marketing, to the extent permitted by law.
  

9) Prohibited Uses

• No unlawful use
  
• No intellectual property infringement
  
• No malware, spam, or scraping
  
• No harassment or discrimination
  

We may suspend or terminate use for violations.

10) Disclaimers & Liability Limit

• Except as expressly stated, the Services and products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind (including merchantability, fitness for a particular purpose, title, or non-infringement).
  
• To the fullest extent permitted, Tradespoke is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits/revenue/data.
  
• Our total liability for any claim will not exceed the greater of:
  
  (a) amounts you paid to Tradespoke for the product/service giving rise to the claim in the prior 12 months, or
  
  (b) $100.
  
  
• Any claim must be filed within 1 year after it accrues, where allowed by law.
  

11) Governing Law; Arbitration; Class Waiver

• These Terms are governed by the laws of North Carolina.
  
• Disputes resolved exclusively by binding arbitration before JAMS (Streamlined Rules) or AAA (Consumer Rules), seated in Mecklenburg County, North Carolina.
  
• Hearings may occur by video if permitted.
  
• No class or representative actions.
  
• Small-claims court in Mecklenburg County is allowed.
  
• Jury trial waived to the extent permitted.
  

12) Changes

• We may update these Terms by posting a new “Last updated” date.
  
• Continued use after changes = acceptance of updated Terms.
